Let’s Have Peace On Earth For Endangered Killer Whales

The holidays are a time for celebration as we come together with family and friends for seasonal gatherings or at places of worship. But this time of year should also serve as a time for reflection. We might do well to reflect on whether we will ever achieve “peace on earth” unless, and until, we are willing to extend goodwill and compassion to the non-human inhabitants (i.e. individuals, families, and communities) with whom we share this planet, especially those whose very existence hangs in the balance. Here in British Columbia, that means killer whales.

Two distinct populations of resident killer whales reside in B.C.’s waters. The Northern Residents are commonly found on B.C.’s north coast and the Southern Residents within the Salish Sea. 

The Northern and Southern Residents differ in population size, population trends, dialects, and importantly, their status under Canada’s Species at Risk Act (SARA). The Northern Residents have a larger, more stable population and are designated as “threatened,” whereas the Southern Residents have an extremely small, declining population, and are designated as “endangered.” Their population has been hovering around 80 since 47 whales were captured and taken for the aquarium trade prior to 1974.

Owing to diminished numbers of Chinook salmon (their primary food), vessel disturbance and underwater noise, pollution, and now facing the pending threat of oil spills, Southern Resident Killer Whales confront a very uncertain future.

Recent viability analysis of their fate by Canadian and U.S. scientists gives them a 50 per cent chance of survival over the next 100 years. Sadly, the population projections for the year 2030 have already been realized, as the number of Southern Residents is now below 80 whales.

The recent death of J32, an 18-year-old breeding female, is a stark reminder of the precipice the Southern Residents stand upon.

Because Southern Resident Killer Whales have been lawfully classified as endangered, the federal government is compelled to implement a recovery strategy that ensures their survival. Yet, the government continues to delay implementation of a credible and comprehensive plan. Their current action plan lacks action, ostensibly because gaps in ecological research are deemed a reasonable excuse for inaction. Twice already, the federal government has lost in court for their failure to act in accordance with science and the law to protect these animals.

After more than a decade of waiting, the Southern Residents are no better off now than when they were listed as endangered 15 years ago. Federal fisheries managers appear unwilling to address the availability of Chinook salmon, an essential food for whales, lest they rile interests in the sports and commercial fishing sectors.

If our grandchildren are to grow up with resident killer whales in the Salish Sea, then crucial decisions need to be made now. For example, an analysis by federal scientists shows that curtailing Chinook fisheries in the ocean can improve the survival rates of these whales. Correspondingly, letting more Chinook salmon spawn could rebuild Chinook runs and provide these whales with the food supply they need.

Federal and provincial governments seem intent on turning critical habitat for killer whales into a shipping corridor for Alberta oil, U.S. coal, and B..C LNG. Moreover, harmful pollutants continue to flow from regional industrial, residential, and agricultural sources into their waters and food. If the National Energy Board knew these whales are unlikely to survive increased tanker traffic – when combined with existing food, pollution, and noise issues – would they be legally compelled to reject Kinder Morgan’s tar sands pipeline and oil tanker expansion proposal?

The federal government’s long-awaited Resident Killer Whale Action Plan finally appeared in 2014. Many had anticipated the plan would include measures to mitigate the hazards confronting the Southern Residents. Alas, the plan failed to include substantive action to reverse what is becoming a grave situation.

But this quandary is not simply a numeric one. Highly intelligent, social, and sensitive, with sophisticated communication skills and very strong familial ties, these whales have an intrinsic right to live their lives.

While the debate regarding the fate of the Southern Residents primarily and understandably takes place in the realm of science, management, and policy, it also brings up issues around ethics, morality, and even spirituality. In fact, I would argue that the matter of what we will choose, or will not choose, to do on behalf of this endangered population of killer whales is, for British Columbians and Canadians, one of the quintessential spiritual decisions of our time.

Having been raised a Catholic, I often times recall the teachings of St. Francis of Assisi. Keith Warner and David DeCosse of Santa Clara University have written that, “St. Francis of Assisi is an example of someone who understood himself to live in a world charged with divine life, in a sacramental world. He was named Patron Saint of Ecologists because he celebrated the beauty and diversity of creation through his prayer and preaching. [In] his ‘Canticle of the Creatures’ Francis sang of all creation as brother and sister. This song is an expression of his moral imagination, because it reflects how he understood himself to live a life of essential kinship with all creation… He viewed the entire created world as members of the divine family… He stands out in Western Christianity as one who lived out a bio-centric vision of the moral life.”

Which brings us once again to the question, if we cannot find the charity in our hearts to allow the Southern Residents to truly recover and regain their rightful place in the coastal ecosystem we both share, then what will that ultimately say about us as a species?

Tribal representatives from both sides of the border spoke in unified opposition today against oil giant Kinder Morgan’s proposed oil pipeline.

Elders, fishers, leaders and youth presented testimony opposing the project to Canada’s National Energy Board in Chilliwack. The NEB will make a recommendation on the future of the pipeline to Canada’s federal government, the ultimate decision-making body for the project.First-Nations-protest-300x225

“We can no longer allow the Salish Sea to be used as a dumping ground,” said Swinomish Chairman Brian Cladoosby. “For more than 150 years we have lived in a pollution-based economy, and today face increased threat of an oil spill in our traditional fishing grounds on the Salish Sea—an event that would very likely lead to irreparable damage to salmon and shellfish habitat, and destroy our way of life along with it.”

The proposed oil pipeline would roughly triple the capacity of the existing pipeline, from 300,000 barrels per day to 890,000 per day. It would run alongside an existing pipeline that stretches from the Alberta tar sands oil fields to an oil shipping terminal in Burnaby, greatly increasing the traffic of oil tankers carrying diluted tar sands bitumen through Canadian and US waters.

“The proposed pipeline, if approved, will increase the risk of oil spills and cause more disruption of our fishing fleet. The Suquamish Tribe has a duty to stand up to further threats to our Salish Sea fishing grounds, which have sustained our people since time immemorial,” said Suquamish Chairman Leonard Forsman.

“If the pipeline is approved, there will be a massive increase in tanker loadings,” said Tulalip treasurer Glen Gobin. “This increased traffic will directly interfere with access to traditional and treaty-protected fishing areas, and put the safety of tribal fishers at risk—not to mention drastically increase the chance of a catastrophic oil spill,” he said. “My father, Bernie Gobin, fought side by side with leaders such as Billy Frank Jr. to ensure that salmon, the very essence of who we are as Coast Salish peoples, live on from generation to generation. We fight for our past and our future.“

Canada’s Coast Salish First Nations also oppose the oil pipeline, and testified before the National Energy Board last week. Those tribes included Shxw’owhámel First Nation, Tsleil-Waututh Nation, Kwantlen First Nation, Musqueam Indian Band, Peters Band. Katzie First Nation and Hwlitsum First Nation also provided testimony.

“Like the sea, Coast Salish people acknowledge no boundaries. We are united to protect the Salish Sea,” said Chemainus First Nation member Ray Harris. “It’s a danger to the environment, a violation of aboriginal fishing rights, and a threat to all people who call this unique place home,” he said.

“We do find lots of support from far and wide, actually surprising support from the Mayors of the Lower Mainland, huge environmental groups that are on our side. I got lots of faith in the future. Hopefully that’ll be there for our kids and grandkids.”

Tulalip councilwoman Deborah Parker said she hoped the protest would be a day for healing.

“Really my hopes are that the NEB and Kinder Morgan will hear our words. and I know they will be some pretty powerful words,” she said. “The words need to keep coming forward so we’re not living in this fear and in as much pain we have been.

“I hope today is not only a day to hear and to listen, but a day to heal.”

Coast Salish peoples are the indigenous people of the Pacific Northwest, and have traditionally lived along the coasts of Oregon and Washington in the United States, and in British Columbia, Canada.

The Salish Sea is a network of waterways between the southwestern tip of British Columbia and the northwestern tip of Washington State, and includes the Strait of Juan de Fuca, Haro Strait, the Strait of Georgia and the Puget Sound.

A New PNW Alliance Aims to Shield the Salish From Destruction

Native Americans, environmentalists, and fed-up citizens unite to keep corporations from turning the region into a fossil fuel corridor

On August 4, a dam holding back mining wastewater burst open in Likely, B.C., gushing roughly 6,604,301,309 gallons of toxic waste into the nearby lakes—a spill 78 percent larger than initial estimates. Only a month after the incident, Imperial Metals, the corporation responsible, declared the water safe to drink again.

“One of my friends caught a salmon alive and kicking there last week,” Sundance Chief Rueben George from the Tsleil-Waututh Nation said to a packed Seattle crowd at the Daybreak Star Indian Cultural Center on Sunday. “But when my friend picked it up, the fish’s skin slid off in his hands.”

Salmon have long been spiritual symbols of the Pacific Northwest—aquatic residents of the Salish Sea that have given life to Coast Salish people for 14,000 years and white settlers for 150. That the skin of the Northwest’s spirit animal is melting off is just one of many reasons organizers say they are forming the brand-new Nawt-sa-maat Alliance, a group that has vowed to defeat oil and coal corporations bent on turning the Pacific Northwest into a fossil-fuel corridor.

Nawt-sa-maat, a Coast Salish word that means “One house, one heart, one prayer,” is an unprecedented trans-border coalition of Coast Salish indigenous nations, environmentalists, interfaith groups, and youth activists that met for the first time this past weekend in Discovery Park. The Alliance’s goal? “To protect the sacredness of the Salish Sea.”

“The tribes are the original environmentalists,” Annette Klapstein, a member of the Seattle Raging Grannies and a new member of the Nawt-sa-maat Alliance, said at the initial meeting on Sunday. Klapstein was one of three protesters who sat on train tracks in Anacortes to block the controversial “exploding” oil trains in July. It was her first direct action after years of fruitless writings to the Seattle City Council and visits to Olympia to persuade politicians to do something about the influx of dangerous rail cars.

“It was always very iffy for tribes to work with environmental organizations because these organizations were arrogant,” Klapstein said. “They would tell tribes what to do, which didn’t go over very well. This new alliance, based on respect and understanding, is so important because these different groups’ goals are much the same, and we are so much more powerful together.”

Chief George, one of the three main founders of the Nawt-sa-maat, presided over the initial meeting and made it clear that one of its biggest enemies was the massive energy company Kinder Morgan. “We stand as one, and together we will protect and restore the sacredness of the Salish Sea,” he said. “Together, we are stronger than those who wish to use our home and waters as a mere highway for dirty oil and coal. Together, we will stop them. Kinder Morgan will not win this battle.”

Formed by Richard Kinder, an ex-Enron employee, the oil mega-corporation is proposing a massive $5.4 billion oil pipeline connecting the Alberta tar sands to the Pacific through Burnaby, B.C., tripling current capacity and creating the potential for enormous spills in the North Salish that would directly affect us in Washington. Canadian Prime Minister Stephen Harper has been pushing the project despite massive backlash from British Columbian activists and the indigenous Tsleil-Waututh, who are now taking the project to court for failing to consult with the First Nations tribe on the federal review.

“You know, I’d like to thank Stephen Harper,” said Nawt-sa-maat co-founder Chief Phil Lane Jr. of the Yankton Dakota and Chickasaw First Nations, “because in his complete unawareness, he’s awakened a sleeping spiritual giant.”

The mood at the meeting was intensely spiritual at times. Four local religious leaders, a United Methodist, a Buddhist, a Sufi, and an Interspirit, came together to bless the gathering in their respective traditions, ending with an indigenous cedar-bough blessing that the crowd happily lined up to receive. Many of the religious groups present vowed to convert their houses of worship to solar energy in an act of good faith.

Being a member of the Nawt-sa-maat effectively means a couple of things. Members are expected to join in a “4 Days of Action” campaign, starting on Sept. 19, that ranges from a salmon homecoming celebration to a climate-change rally at the Canadian border and ends with an international treaty signing that will effectively ratify the new trans-border Nawt-sa-maat Alliance. Members are then expected to join in future actions and work to build the nascent network, which will soon expand its scope to tackle the proposed coal-extraction sites at Cherry Point, sacred land to the people of the Lummi Nation near Bellingham.

“I just want to make this very clear,” Chief George said as he doled out salmon to the Nawt-sa-maat near the meeting’s end, “this Alliance isn’t just for one group. It’s for everyone. The Salish Sea is for everyone, not just corporations. We will win this fight.”

The Center for Whale Research is celebrating the birth of an orca calf in the Salish Sea, the first one since 2012.

The proud mother is 23-year-old L86, and this is her second calf. The newborn has been designated L120.

The birth is sorely needed in the Southern Resident Community population, Michael Harris, Executive Director of the PWWA, said in a press release. Their numbers had just dipped to 78, the lowest count in over a decade.

Meanwhile, the Northern Resident Community of British Columbia have steadily increased in numbers, and transient or marine mammal-eating orcas seem to be thriving in the Sound and Straits.

Yet the Southerns continue to struggle to recover, Harris said. Researchers attribute the problem to lack of prey, primarily their preferred diet of wild Chinook salmon.

A Pacific Whale Watch Association crew was the first to snap and post the baby photos.

“We wouldn’t have known about it, but heard from David Elifritt out on the water that L86 had a new calf, and then ran into them,” said Capt. Jim Maya of Maya’s Westside Whale Charters on San Juan Island. “What a thrill to be there at the right time in the right place. Everyone on board was so excited. I’ve never seen a calf born, but it’s always a thrill to be there the day a new calf was discovered.”

“I remember someone saw a shot of L86 breaching back in June and word got out that she had a little ‘baby bump,'” explains Michael Harris, Executive Director of the PWWA. “This is great news. But every time a baby’s born, we’re careful not to pass out the cigars too soon. Infant mortality is really high among wild orcas, especially these Southern Residents. This little whale has a tough road ahead. Every birth is exciting, but we’ll be especially thrilled and relieved to see L120 rolling back into the Sound and Straits next summer.”

LA CONNER, Wash. – With 95 percent of the Swinomish Indian Tribal Community’s reservation borders on the water, the tribe is concerned about the rise in sea level and storm surges expected as the planet warms.

As sea level rise pushes high tides and winter storm surges farther inland, coastal tribes in the Northwest worry that their archaeological sites will be wiped out, Swinomish Tribal historic preservation officer Larry Campbell said. They also worry that traditional food sources like salmon and oysters may be affected.

Campbell said food and medicine resources used by tribes around the country have moved or disappeared altogether in some places from where they were traditionally gathered, which is believed to be a result of the changing climate and shifting weather patterns. Those changes affect not only physical access to the natural resources, but the cultural well-being of the tribes.

“It’s important when you look at overall health to look at not just the foods and the resources, but the gathering,” Campbell said. “There’s a process of gathering these things that’s traditional in nature.”

Traditions are passed down through generations as elders share family gathering secrets with their next of kin, he said.

The Swinomish tribe has gained national recognition for its commitment to protecting the culture and natural resources of the Skagit Valley in the face of climate change and is gearing up to begin a new research project. Building off past studies, the tribe will evaluate both the physical and social impacts climate change may have on local near-shore environments.

Swinomish environmental health analyst Jamie Donatuto said the study will build upon earlier research by looking at indigenous health indicators, which take into account cultural, familial and emotional aspects of the impacts climate change may have on the natural resources the tribe values.

Over the course of the three-year study, Swinomish environmental specialist Sarah Grossman will lead efforts to monitor waves and winds on the shorelines during the winter, when storm surges roll in. She will also lead beach surveys to document characteristics like sediment, wood debris and eelgrass cover.

Donatuto will lead the social science side, organizing a series of spring workshops to invite the community to review and discuss the scientific data collected.

“You can’t assess health without actual conversations with community members,” she said.

A $756,000 U.S. Environmental Protection Agency Science to Achieve Results program grant was awarded in June to support the multiyear project.

Swinomish intergovernmental affairs liaison Debra Lekanof said the Swinomish have invested $17 million in collaborative work on the nation’s natural resources over the past 10 years.

“We’re protecting the universal resource rather than the tribal resource. We’re doing a lot more for the state and the county, and then in the end the tribe benefits by taking care of the whole,” Campbell said. “We’re a very aggressive tribe when it comes to our environment.”

The tribe has also been chosen as a finalist for the Harvard Project on American Indian Economic Development’s Honoring Nations Program. The program, run by the John F. Kennedy School of Government at Harvard University, “identifies, celebrates and shares excellence in American Indian tribal governance.” This year, the tribe gained its place among 18 finalists in the running for the single “High Honor” because of its climate change initiative. The winner will be announced in October.

The Swinomish Indian Senate passed a proclamation on its climate change initiative Oct. 2, 2007, that marked the start of the tribe’s commitment to addressing the potential effects of climate change. The tribe developed an Impact Assessment Technical Report in 2009 and a Climate Adaptation Plan in 2010 that have provided a framework for other tribes to follow, and has continued to conduct related research, Donatuto said.

En route to the territory of the Heiltsuk First Nation, pullers in the 2014 Canoe Journey traveled through territory so beautiful it will be impossible to forget: Rugged, forested coastlines; island-dotted straits and narrow, glacier-carved passages; through Johnstone Strait, home of the largest resident pod of orcas in the world, and along the shores of the Great Bear Rainforest, one of the largest remaining tracts of unspoiled temperate rainforest left in the world.

They also traveled waters that are increasingly polluted and under threat.

Pullers traveled the marine highways of their ancestors, past Victoria, British Columbia, which dumps filtered, untreated sewage into the Salish Sea. They traveled the routes that U.S. energy company Kinder Morgan plans to use to ship 400 tanker loads of heavy crude oil each year.

Canoes traveling from the north passed the inlets leading to Kitimat, where heavy crude from Enbridge Inc.’s Northern Gateway pipeline would be loaded onto tankers bound for Asia, a project that Canada approved on June 17.

Young activist Ta’kaiya Blaney of the Sliammon First Nation sang of her fears of potential environmental damage to come in her song, “Shallow Waters”:

“Come with me to the emerald sea / Where black gold spills into my ocean dreams.

“Nothing to be found, no life is around / It’s just the sound of mourning in the air.”

Mike Williams Sr., chief of the Yupiit Nation and member of the board of First Stewards, noted that the Canoe Journey route calls attention to the fragile environment that’s at stake. First Stewards, an indigenous environmental advocacy group, will host a symposium on “Sustainability, Climate Change & Traditional Places” from July 21–23 in Washington, D.C.

“The Canoe Journey is a really big statement to us to hang onto our culture and our way of life, and to bind people together,” said Williams, who is also a well-known musher. “In the Iditarod, there are pristine places but there are also old mining towns [on the route] where we’re told not to drink the water.”

The parallels between the water issues encountered on the Iditarod and the Canoe Journey are unmistakable, he added.

“In the Canoe Journey, there are pristine waters and there are waters that contains toxic substances,” Williams said. “There’s oil and the continuous leaking of pipelines. It happens.”

Not only does it happen, but it does not go away. Prince William Sound has never totally recovered from the Exxon Valdez oil spill, Williams said. Likewise, he added, if the Northern Gateway pipeline, the coal trains and increased shipping come to fruition, an environmental disaster is inevitable.

“It’s going to happen,” Williams said. “There has to be total, thoughtful conversation for everyone—consider all the possible impacts. And there has to be meaningful consultation with the tribes. They have to weigh in on that. We’ve got to make it 100 percent fail-safe or don’t do it.”

State Senator John McCoy, D-Tulalip, is a citizen of the Tulalip Tribes. He is the ranking member of the Senate Energy, Environment & Telecommunications Committee, which focuses on such issues as climate change, water quality, toxic chemical use reduction and cleanup, and management of storm water and wastewater.

“I think the message is, pollution is occurring everywhere,” McCoy said of the takeaway from the Canoe Journey. “It’s a worldwide problem, and it needs to be addressed. If we keep polluting our water, we’re going to be in big trouble. Water is the essence of life.”

Canoes were underway for Bella Bella on July 9 as Governor Jay Inslee announced that he wants to increase the recommended fish-consumption rate in the state from 6.5 grams to 175 grams a day—that’s good news for indigenous peoples, for whom fish is important culturally, spiritually and as a food. But for 175 grams of fish to be considered safe to eat, businesses that pollute will have to conform to tougher pollution control standards.

Inslee’s plan for how toxic substances will be controlled in expected in December. It will require legislation, McCoy said.

Jewell James is coordinator of the Lummi Treaty Protection Task Force and a leader in the effort to prevent a coal train terminal from being built at Cherry Point, a sacred area for the Lummi people and an important spawning ground for herring, an important food for salmon.

James said environmental degradation is just part of a series of historical traumas set upon Indigenous Peoples: First, the diseases that came after contact; then the treaty era and the relocation to reservations; then the cultural and spiritual oppression of the boarding school era, and then the termination era.

“Yet we continue to exist,” James said. And the Canoe Journey, now in its 23rd year, has helped “revitalize and breathe new life into our cultural knowledge” given that journey gatherings are venues for the passing down of stories about how the ancestors lived in and cared for the environment that sustained them.

James hopes people on the Canoe Journey connect with and carry on those stories and values.

“There are messages in those stories,” he said. “And within those stories there are sacred symbols that mean something—that you have to be careful with what you do, and others have to be careful with what they do, to Mother Earth.”

Puget Sound is one of the iconic wonders of the world and defines who we are, not only as tribes, but all residents of Western Washington.

This great body of water was still being formed by receding glaciers when the tribes arrived, and we have lived off her abundant natural resources ever since. Over thousands of years our beautiful and unique inland sea has become a complex ecosystem, supporting not only an abundance of sea life, but also mixing with freshwater resources at the mouths of our great rivers, providing a consistent and plentiful food source for us humans.

This natural resource wealth has influenced every part of our tribal traditions. Stories of the great salmon runs have been carried down through the generations, and they tell us these waters once rippled with silver, as salmon arrived home after several years out to sea. The clams, crab and mussels were also abundant, and along with berries, roots and the plants we harvested, our traditional diet was, and continues to be, sacred to us.

The old Indians used to say, “When the tide is out, the table is set!”

For more than 200 years the descendants of the settlers, and now peoples from around the globe, have called the Puget Sound home. Like the tribes, they have lived off her rich resources, appreciated her great beauty and passed laws to protect her from exploitation.

Today, however, the health of Puget Sound is failing fast. In recent years it has lost 20 percent, or more, of the plankton that makes up the base of our food web. Everything above plankton in the food chain is also affected and is showing signs of great stress. The loss of plankton is beyond comprehension and is the single greatest barometer of what is happening to the waters we have all largely taken for granted.

It is time the citizens of Washington, and in particular citizens of Puget Sound, act on this information. With plankton gone, it means every animal up the food chain pays the price, including us.

Mark my words: Puget Sound is dying! Finding whales dying from natural causes is expected. Finding whales that are emaciated and starving is alarming and will become a common scenario if we do not address the problem quickly. But what is happening; why are plankton dying? We are only beginning to understand the complex interactions between warming ocean waters, how they affect the state’s inland sea, and how human activities play into this alarming situation.

Toxins in the food chain are devastating from the bottom all the way up. Recent evidence suggests that nutrient pollution, such as nitrogen and phosphorus from wastewater treatment plants, septic systems, residential homes, agriculture and other sources, are significantly disrupting the food web in Puget Sound. We cannot continue to ignore the fact that the sound is the baseline of our livelihoods and that we humans are only as healthy as our environment.

The great waters and rivers of the Salish Sea have existed since the last ice age (13,000 years ago) and with the melting of the ice the Puget Sound was born. Mother Nature has created this beautiful place we call home, and in less than 200 years, and largely within the last 100 years, we have managed to undo what Mother Nature provided us.

How many more years will it take to entirely wipe out sea life in Puget Sound? Can she sustain the barrage of pollutants that are killing the plankton for another 50 years? Do we have another 25 years to act before reaching the tipping point, or have we already arrived? Our window of opportunity to heal her is closing. It is our duty to do all that we can to improve her health and time is not on our side.

The Tulalip Tribes have collaborated with governments, nonprofits, and other entities on a variety of habitat restoration projects, on and off reservation, and we continue to lobby for the protection of Puget Sound. One project that we feel very proud to be a part of is Qualco Energy. Partnering with farmers and environment groups in the Snohomish River basin we have worked together to build an anaerobic digester, which channels cow manure away from streams and fresh groundwater sources by converting it to electricity before it is sold to the electricity grid. It is an example of the type of collaboration it will take to restore the health of our Sound.

Gov. Jay Inslee announced his proposal this week to address the issue of fish consumption that has large implications for our health and water quality standards. Gov. Inslee’s proposal begins to address Puget Sound’s health but not to the level that we had hoped. While the proposed rate of fish consumption is significantly higher, his proposal also increases the risk of cancer deaths by some toxins. The governor’s proposal strengthens water quality with one hand, but weakens it with the other. The net effect seems to be a very modest change for some chemicals, and no change at all for others. It also represents yet another delay on committing to the health of the Puget Sound, and to the health of those who depend on its resources.

There are no winners in the governor’s announcement. We want to be able to encourage our people to eat more fish and shellfish, as it sustained them well for many generations, and forms the basis of our shared ways of life. We remain hopeful that the court of public opinion will convince the governor to reconsider his proposal so that when the tide is out it is safe to eat at the table.

Field Notes: a Visit to Lummi Nation’s Sacred Summit and the Protection of the Salish Sea

The 10 day Water Festival hosted by The Lummi Nation of Washington State wrapped up on June 22nd. I had the opportunity to attend part of the festival, along with another law student volunteer and WCEL Staff Lawyer, Eugene Kung. The part we were present for was the Stommish Sacred Summit, which consisted of a day of presentations on the topic of Sacred Obligations, a talk by Winona LaDuke, and a rally against a proposed coal port in the Salish Sea. These events hold great relevance for the environmental movement and the fight against fossil fuel projects in Canada.

 

 

The Lummi are Coast Salish people, whose combined traditional territory stretches throughout the Pacific Northwest, from the northern limits of the Strait of Georgia through Puget Sound (together known as the Salish Sea), and covers present-day Vancouver, Victoria and Seattle. The Lummi have close trade, cultural and family ties with Tsleil-Waututh, Squamish and Musqueum, the Coast Salish First Nations that may be more familiar to the Canadian audience. The Oregon Treaty of 1846, which set the present-day Canada-USA boundary, determined their divergent courses of history. And yet, as my fellow law student volunteer Elizabeth Zarpa put it:

Their lineage and kinship with other Coast Salish nations stretches across international boundaries here in Canada. The struggles which they face against natural resource companies imposing pipelines, railways and tankers throughout their territories is similar to what other First Nations in Canada experience.

Stommish Sacred Summit

The Water Festival includes such events as a film festival, canoe races, a carnival and the Sacred Summit, and it is part of the cultural revitalization efforts by the Lummi Nation. The Sacred Summit in particular was organized in accordance with the Lummi traditional laws, opening with a prayer and selection of prominent community members to act as witnesses. I am personally always honoured and excited to attend such events, because of the palpable resilience and sacredness of Indigenous traditions. It helps that there is usually bannock being served.
The day’s events were held in a giant longhouse supported with massive cedar trunks, some of which have been carved into beautiful totem poles.

 

The day began with welcomings from elected council member Jay Julius and Hereditary Chief Tsilixw. Despite the two representing different sources of leadership, one from a Tribal Council established by the United States government and the other from a traditional system of governance, they both spoke about the sacred obligation to protect the environment in their traditional territory. To them, the environment is not something external to human life, but is the source of their livelihood. Lummi have survived and thrived off of salmon, clams, mussels and other seafood abundant throughout the Salish Sea since time immemorial.

Resource extraction projects would inevitably contaminate the coastal waters and the seafood and so they would threaten the very way of life of the Lummi. The idea of protecting the environment is not just rhetoric for them, but is a matter of survival and sacred duty. We also heard from Jewell James, who Environmental Law Alert readers may remember as the master carver and spiritual leader that gifted a totem pole to the Tsleil-Waututh as a symbol of solidarity among Coast Salish Nations opposing destructive fossil fuel projects.

The Canadian Connection

The cross-border links became even more obvious when the two Canadian guests spoke: Rueben George, the Sundance Chief of Tsleil-Waututh, and Eugene Kung, staff lawyer at West Coast Environmental Law. Rueben spoke of the shared culture of the Lummi and Tsleil-Waututh. Despite the many years of being separated by an international border, their shared understanding of the responsibility for the environment persists. For the Tsleil-Waututh, the idea of sacred obligations to the environment found expression in the Sacred Trust Initiative, whose goal is stopping the Kinder Morgan Trans Mountain pipeline expansion. Their resistance was motivated by their experience with the existing pipeline, which has had four major leaks since 2005. Because of this and other industrial developments in the Burrard Inlet, it has been harder and harder for the Tsleil-Waututh to practice their traditional way of life. Rueben doesn’t want this to happen to the Lummi, and he encouraged them to keep up their fight against the local resource extraction projects.

Eugene then spoke more specifically about the Kinder Morgan pipeline expansion proposal, the flawed National Energy Board process, and the legal aspects of the resistance to this project. This Canadian project is important for the Lummi, because the tanker traffic, set to increase to 400 tankers a year, would cross their territory and threaten their water as well.

The environment transcends national borders, contaminants transcend national borders, just as the environmental movements and the Coast Salish culture should transcend national borders. Eugene also explained how strong indigenous laws can help the greater environmental movement through such legal tools as the duty to consult and accommodate where Aboriginal rights and title are involved.

Coal Port at Cherry Point

The Lummi are facing their own fossil fuel project: a proposal to build a deep-water marine terminal at Cherry Point, which would become North America’s largest coal port, exporting up to 54 million dry metric tons per year. The project got off to a rocky start with the Lummi Nation, when in 2011 the company behind the proposal failed to obtain government permits for some preliminary work but went ahead with it anyway and ended up disturbing an ancient burial site. Now, as the Sacred Trust Initiative reports, “The Lummi Nation is concerned not only about the destruction of their sacred sites, but also about the deterioration in air quality and contamination of water and soil as a result of fugitive coal dust dispersal. Shipping of coal could also have devastating impacts on fishing and fishing rights along the Washington coast.” The Lummi do have a strong legal case based on treaty fishing rights, so much so that the US Army Corps of Engineers considered denying permits for the proposal based solely on their opposition.

Getting Out of the Fossil Fuel Economy

The highlight of the Sacred Summit for me was a very inspiring talk by Winona LaDuke, an internationally renowned Anishinaabekwe (Ojibwe) activist. People from all over Whatcom County, Bellingham and Seattle joined us for her talk. Environmental work can sometimes feel like a game of whac-a-mole, with a new pipeline or coal mine or refinery being proposed every few months. We live in the fossil fuel age, from the car-friendly infrastructure of our cities to the policies and subsidies our governments use to promote an oil-based economy. Ms. LaDuke reminded us of the bigger picture, of the dangers posed by climate change, of the inevitable end to big oil. We should be aiming for a graceful transition instead of a catastrophic crash, and we should do it as soon as possible. Every pipeline that we stop should give our governments pause about their energy policies. Every renewable energy project and conservation measure will decrease our own dependence on fossil fuels.

The evening wrapped up by calling forward the witnesses, who gave their reflections on the evening. Their job throughout the day was to make sure everything was done properly, and their reflections legitimized the event according to traditional Lummi law. I could feel the significance of following protocol and doing things property in this great longhouse, and how the Lummi drew strength from the thousands of years of history so they can continue to fulfill their sacred obligations.

West Coast Environmental Law has long been working within the Canadian legal system to advance and uphold indigenous laws to protect the environment. This trip gave me a more international perspective on our work and reminded me that there are a lot of people – Aboriginal and not – fighting for a better world. This Earth is of all of our home.

Sea Star Wasting Syndrome Perplexes Scientists

Puyallup Tribe Observes Disease Affecting Sea Stars

As part of its regular crab population monitoring, the Puyallup Tribe of Indians is tracking the impact of a myste-rious ailment that is killing sea stars.

An outbreak of sea star wasting syndrome was first noticed last fall in British Columbia. The syndrome starts as small lesions and eventually the infected sea stars disintegrate. Since symptoms were first noticed, the syndrome has quickly spread throughout the Salish Sea and along the Pacific coast.

While there have been previously documented outbreaks, nothing on this scale has ever been recorded. There is no known cause.

“After we started conducting crab surveys in April last year, we started seeing a lot of sea star by catch,” said George Stearns, the tribe’s shellfish bi-ologist. “One pot near the north

point of Vashon Island was full of sea stars.”

The tribe regularly monitors eight stations between the north end of Vashon Island and the Tacoma Narrows. Each station includes nine crab pots.

During the tribe’s early surveys, the sea star population seemed healthy. But Puyallup tribal scientists recorded a sharp die-off in October.

“We saw one monitoring site go from four sea stars per pot in April to 12 in September to zero in October,” Stearns said.

When a diseased sea star catches a ride on a tribal crab pot, it deflates quickly. Within a few minutes, a normally rigid sea star will be hanging on the pot like a wet rag.

“Some of the sea stars we are finding are literally melting in front of us,” Stearns said.

 

Tribe Narrowing Locations Where Crabs Molt

The Puyallup Tribe monitors crab to pinpoint exactly when the shellfish in the tribe’s harvest area molt, or shed their shells.

“Crabbing during the middle of molting, which makes them soft and vulnerable, can increase the handling mortality,” said George Stearns, the tribe’s shellfish biologist. “It’s a common practice to shut down harvest during the molt. But we’ve

only had a general idea of when that occurs down here.” The data collected will also

help the fisheries managers put together a more complete picture of crab populations in South Sound.

“We GPS the locations so we’re at the same spots and put the pots in for the same length of time,” Stearns said. “So we know we’re comparing apples to apples each month.”

 

 

U.S., Canadian, tribal leaders discuss Salish Sea’s environmental, economic concerns

This isn’t breaking news, but salmon and orcas don’t stop at the border. They don’t show passports and clear customs or shop at the duty-free store.

The environment doesn’t stop at the border and neither does the economy. A healthy economy depends on a healthy environment and we must work across the border with our Canadian and tribal/First Nations partners to ensure both.

This week in Seattle, Western Washington University is the proud lead organizer of the Salish Sea Ecosystem Conference bringing together about 1,200 of the top marine science professionals, First Nations and tribal leaders, industry executives and policymakers who make decisions about resource management on our shared waters. The Salish Sea encompasses all of the inland marine waters of southern B.C. and Western Washington, from the Johnstone Strait at the top of Vancouver Island to the bottom of Puget Sound near Olympia. The Salish Sea also includes the Georgia Strait in Whatcom County and B.C., as well as the San Juan Islands, Hood Canal and the Strait of Juan de Fuca out to the Pacific Ocean.

Our region’s future demands that we have serious conversations across international and jurisdictional boundaries about the decisions before us in marine resource management. Since the 1970s, Western has reached beyond the Canada/USA border with our research and teaching on environmental and economic issues. WWU’s Huxley College of the Environment and Center for Canadian-American Studies have been leaders in thinking, and acting, across the border with common sense solutions for over 40 years.

This week, we live it.

This is not underwater tree hugging. The Salish Sea Ecosystem Conference is an important dialogue about the future of our marine waters and the jobs that depend on them.

We cannot just yell at each other about coal trains and jobs. We must sit down at the table together and weigh the pros and cons of decisions that will affect our children’s health and economic well-being for generations to come.

This week, Western provides that table, and the forum for the exchange of information that will lead to intelligent decisions. More than 450 scientific presentations will be delivered this week at the Washington State Convention Center by scientists from both sides of the border. The goal is, quite simply, to provide the best scientific and policy research that can lead to decisions that will foster the long-term health of the Salish sea and the economy that depends on it.

It is crucial that we work with our neighbors and partners to understand the latest scientific research, so we can make the smartest decisions for our region’s future. Western Washington University’s mission is to serve the people of our region by encouraging learning. This week, we proudly carry that mission forward as lead organizer of the Salish Sea Ecosystem Conference.

Bellingham is at the heart of the Salish Sea, and WWU is proud to be at the heart of this important conference.
