Tribes prevail, kill proposed coal terminal at Cherry Point

The U.S. Army Corps of Engineers sided with Northwest tribes Monday in a decision to block the largest proposed bulk-shipping terminal in North America at Cherry Point.

The Lummi Nation has prevailed in its fight to block the largest coal port ever proposed in North America, at Cherry Point.

The U.S. Army Corps of Engineers, the agency reviewing permits for the deep water port project, agreed with the tribe Monday that it could not grant a permit for a project that would infringe on the Lummi Nation’s treaty-protected fishing rights.

The 34-page decision was celebrated by community groups and tribes all over the Northwest that opposed the coal port.

The developer, SSA Marine of Seattle, declared the decision “inconceivable” and political, rather than fact-based. Bob Watters, SSA senior vice president and director of business development, said the company was “considering all action alternatives.”

But legal experts said far from outlandish, the decisionfollowed federal obligation to protect tribal treaty rights and the habitat that makes those reserved rights meaningful.

“This is based on a long line of precedent,” said Robert Anderson, director of the Native American Law Center at the University of Washington School of Law. “You can’t have a right to fish without a decent environment.”

Lummi fishing rights and the associated habitat are property rights protected against interference by states, the federal government and private parties, Anderson noted.

Tim Ballew II, chairman of the Lummi Indian Business Council called the decision “a big win for Lummi and for treaty rights and for Indian Country.” The tribe argued the project was a killer for its crab fishery and would thwart rebuilding the herring run that was once the prize of Puget Sound.

The terminal would have brought some of the largest ships afloat into the usual and accustomed fishing waters of the Lummi up to 487 times a year to load and unload bulk commodities, principally coal, bound for Asian ports.

The project touched a nerve on both sides of the border among communities fighting coal and oil transport projects — none larger than the port proposed for Cherry Point, the last undeveloped bit of shore on a deep-water cove, between a smelter and two oil refineries.

The Lummi fought the project from the start. The tribe was opposed not only to increased vessel traffic and risk of pollution from the project, but any disturbance of the site of one of its oldest and largest villages and burial grounds, upland from the proposed shipping terminal.

Promises by the developer to minimize and scale back the landside footprint of the project did not interest the Lummi, who argued the project could not be mitigated.

While SSA voiced shock at the decision, some industry analysts said it merely put a project that was never going to be economically viable out of its misery.

“This is like cutting the head off a zombie; it stopped making economic sense years ago, and now it’s officially dead,” said Clark Williams-Derry, director of energy finance at the Sightline Institute in Seattle. With coal prices in a long slide and no recovery in sight, the project had no financial future, Williams-Derry said.

“They have no market for the coal,” agreed Tom Sanzillow, based in New York as the director of finance for the Institute for Energy Economics and Financial Analysis, a nonprofit think tank. Coal-export projects are “wasting a lot of investor capital and people’s time,” he said.

The campaign against the project was hard-fought and its foes implacable. Brian Cladoosby, president of the National Congress of American Indians and chairman of the Swinomish Indian Tribal Community in La Conner, called coal “black death,” and vowed tribes would fight the project to the end.

Cladoosby said Monday, “Today was a victory not only for tribes but for everyone in the Salish Sea. I hope we are reversing a 100-year trend of a pollution-based economy, one victory at a time.”

Tribal opposition to the project from around the region was good news for citizens from Seattle to Bellingham and beyond, noted Cesia Kearns, based in Portland as deputy regional director of the Beyond Coal campaign for the Sierra Club. “Protecting treaty rights also protects everyone who calls the Salish Sea home. I feel just an incredible amount of gratitude,” she said.

Mel Sheldon, chairman of the board of directors for the Tulalip Tribes, which also have treaty-reserved fishing rights at Cherry Point, said the port would have taken away a way of life not only for those who fish, but for tribal and nontribal residents who treasure the environment. “This is a journey we are all on.”

The decision was made by the Seattle District commander, Cmdr. Col. John Buck. If in the future the Lummi withdrew their opposition, SSA Marine can restart the permitting process, the corps noted.

But Ballew made it clear that is not on the table.

“We have always made our treaty rights and protection of the Ancient Ones our first priority,” Ballew said. “And we always will.”

Washington State’s rail system is aging, and that combined with the flammability of Bakken crude oil spell danger for ecosystems and people, a top official and 10 tribes said in a Seattle Time sop-ed on November 20.

The Quinault have spoken out numerous times against such rail transport, a practice with potentially tragic consequences as evidenced by the July 2013 explosion in Lac Megantic Quebec, that killed at least 47 people.

The Quinault as well as Washington State Commissioner of Public Lands Peter Goldmark, issued a joint statement in conjunction with the op-ed piece. Tribes, Goldmark noted, are rightfully at the forefront of this debate.

“Tribal leaders bring unique perspective and concern about threats to our treasured landscapes,” Goldmark said in the statement issued jointly with the 10 tribes. “It’s an honor to join them in this important message about the growth of oil train traffic in our state and the threat it poses to public safety, environmental sustainability, and our quality of life.”

Swinomish Tribe Chairman Brian Cladoosby said it was time to move away from the Northwest’s “pollution-based economy” in general and oil trains in particular.

“We are the first peoples of this great region, and it is our responsibility to ensure that our ancestral fishing, hunting and gathering grounds are not reduced to a glorified highway for industry,” said Cladoosby, who is also president of the National Congress of American Indians (NCAI), in the statement posted at the website of the Washington State Department of Natural Resources. “Our great teacher, Billy Frank, Jr., taught us that we are the voices of the Salish Sea and salmon, and we must speak to protect them. If we cannot restore the health of the region from past and present pollution, how can we possibly think we can restore and pay for the impact of this new and unknown resource?”

Besides Cladoosby, Goldmark and Quinault Nation President Fawn Sharp, the statement was signed by Lummi Nation Chairman Tim Ballew II; Confederated Tribes of the Colville Reservation Jim Boyd; Cowlitz Indian Tribe Chairman William B. Iyall; Hoh Indian Tribe Chairwoman Maria Lopez; Squaxin Island Tribe Chairman David Lopeman; Quileute Tribe Chairman Charles Woodruff; Tulalip Tribes Chairman Herman Williams Sr., and Gary Burke, chairman of the board of trustees of the Confederated Tribes of the Umatilla Indian Reservation.

Together they urged policy makers to take up critical regulatory issues surrounding the increased traffic of oil trains throughout the state of Washington.

Wyoming Offers Northwest Tribal Leaders A Free Trip To Coal Country

Treaty fishing rights give Northwest tribes extra clout when it comes to the future of proposed coal terminals on the Columbia River and Puget Sound.

That’s not lost on the governor of Wyoming, a big proponent of coal exports.

Gov. Matt Mead is inviting Northwest tribal leaders on an all-expenses-paid trip to coal country in Northeastern Wyoming, according to an email obtained by EarthFix.

The governor’s invitation went out to tribes in Oregon and Washington, including the Umatilla, Yakama, Swinomish and the Lummi.

The governor’s office did not answer specific questions about the invitations, but released a statement saying the trip would “showcase Wyoming’s coal and rail industries, the benefits of low sulfur coal, world class reclamation and the economic benefits coal provides to the local community.”

The statement, sent by email from Michelle Panos, the governor’s interim communications director, says that Wyoming has been hosting policy makers from the Pacific Northwest for the last few years, and “Wyoming recognizes tribal leaders as key policy makers.”

Courting Coal’s Critics?

Tribes have been vocal critics of coal exports in the Northwest, and their treaty fishing rights give them unique power to stop terminal developments. It’s unclear whether the free trip to Wyoming is intended to change their stance.

The two-day tour would visit one of the largest coal mines in the world, a power plant and rail operations, according to a Sept. 25 email sent by Loyd Drain, executive director of the Wyoming Infrastructure Authority. And the state of Wyoming would pick up the tab.

“The Wyoming Infrastructure Authority, an instrumentality of the state of Wyoming, would be pleased to provide for the cost of airfare; lodging; transportation in Wyoming; and meals,” Drain wrote in one of the emails.

The invitation calls the tour “an opportunity with an up-close look at the operations being conducted in an environmentally friendly manner.”

Drain did not respond to requests for comment.

Chuck Sams, spokesman for the Confederated Tribes of the Umatilla Indian Reservation, said the chairman of his tribal council, Gary Burke, received an invitation last week but hasn’t decided whether he will accept.

“We received an email from the governor of Wyoming inviting us out,” Sams said. “We haven’t made any decisions regarding the invitation.”

Earlier this year, the Umatilla and several other tribes argued successfully that a proposed coal export project on the Columbia River would interfere with their tribal fishing rights.

The state of Oregon denied a permit needed to build a dock for the Morrow Pacific project in part because tribal members say they fish at the proposed dock site.

Mead Sees Exports In Coal’s Future

Mead visited another proposed coal export terminal site in Longview, Washington, earlier this year to show his support for the project and tour the facility. The Millennium Bulk Terminals project would export up to 44 million tons of coal a year from Wyoming and Montana to Asia.

“That’s a lot of coal, but relative to the amount of coal we produce it’s 10 percent,” Mead said during his visit. “So this port and other ports are important to Wyoming in terms of the coal industry.”

Wyoming produces around 400 million tons of coal a year. With the U.S. tightening regulations for coal-fired power plants, Mead said he sees exports as a key part of the coal industry’s future.

Not All Tribes Agree

The Powder River Basin coal reserves of Wyoming and Montana are partly located on tribal land. The Crow Nation signed a deal with Cloud Peak Energy, giving that company the option to mine up to 1.4 billion tons of Crow coal. Some of the coal mined there would be exported through terminals proposed to be built in Washington. The move pits the Crow against tribes in the Northwest, which oppose coal exports.

“The economic viability of the Crow Nation is closely tied to our ability ship natural resources, especially coal, out of Montana,” said Crow Tribal Chairman Darrin Old Coyote. “Energy exports are a key piece of our future well-being and we are encouraged by this proposed rail and port infrastructure in the Northwest that will help grow interstate commerce.”

As for the all-expenses-paid trip to Wyoming coal country, Timothy Ballew, tribal chairman of the Lummi Nation, whose lands are adjacent to the site of the proposed Gateway Pacific Terminal, said he will not be attending.

Chairman Ballew and the Lummi council sent a letter in response to the Wyoming governor’s offer. In it, Ballew said, “there is no purpose to be served by accepting your offer. We are well aware of the nature of the coal mining industry and its impacts on the environment.”

The letter goes on to say that the operation of the Gateway Pacific Terminal represents “an unacceptable and unavoidable interference with our treaty fishing rights … and will result in the desecration of an area of great cultural and spiritual significance to our past, our people, and our ancestors.”

Stillaguamish Tribe chairman named to Indian fisheries post

Shawn Yanity, chairman of the Stillaguamish Tribe, has been elected vice chair of the Northwest Indian Fisheries Commission.

“I’m there for the commission to help carry the voice of the 20 tribes in their interests,” Yanity said. “It’s a huge honor, and it’s a huge responsibility.”

The commission, based in Olympia, represents 20 tribes in the state, with a member from each tribe serving in the group. A chair, vice chair and treasurer are elected from among the commissioners.

Former Chair Billy Frank Jr. died in May at age 83. He is remembered as a lifelong fisherman, a passionate advocate for the fishing and hunting rights of Northwest tribes, and a longtime leader of the commission.

Lorraine Loomis, fisheries manager for the Swinomish Tribe and previous vice chair of the commission, was selected as the new chair.

Yanity, 49, became chairman of the Stillaguamish Tribe in 2004 and has been on the fisheries commission since 2000.

“Together we focus on all the treaty issues, everything from clean water to salmon, shellfish, groundfish and wildlife,” Yanity said.

The commission provides resources for tribes facing specific concerns, such as microbiologists to handle disease outbreaks at fish hatcheries. The group also acts as a sort of database on Washington fish and their habitats, from mountain streams to the salty coastline.

Commission goals include upping wild salmon populations, pushing for legislation to prevent pollution in Puget Sound and cleaning up rivers and streams around Western Washington, Loomis wrote in a message to the commission earlier this year.

“Our tribe can be a little more active in this,” Yanity said. “It’s an honor for us to do that, but now we have to step up to the plate a little more and honor those responsibilities and traditions.”

Frank left his wisdom and teachings for the commission, Yanity said. The group aims to follow in his footsteps, pushing for cleaner waters, protecting native fish populations and advocating for the tribes’ treaty rights to fish and hunt throughout the state.

“The commission has a lot of important work that’s set out before us, and the committee is still as strong and dedicated to protecting the treaty resources as we’ve always been,” Yanity said. “But we know that we lost a great leader.”

 

Missing Section Of Nez Perce Trail Holds Little-Known Part Of History

The story most people learn about the Nez Perce Tribe and the capture of Chief Joseph doesn’t tell the whole history.

Now the federal government and Northwest Tribes are trying to fix that with a new historic site.

You may have heard about the Nez Perce’s epic 1,200-mile flight through Oregon, Idaho, Wyoming and Montana in 1877. The U.S. Army caught up with them before they could reach Canada. And in history books and documentaries, the story usually ends with the tribe being forced to surrender just 42 miles from the border — and freedom.

But in fact, for about a third of the Nez Perce, it didn’t end there. Nearly 300 people escaped the battlefield and did cross into Canada.

Ruth Wapato’s grandfather was one of them. Wapato is part of a group that’s been working to get the federal government to recognize the final leg in the Nez Perce National Historic Trail.

“They weren’t all off together, some up front, some way behind,” Wapato said. “Their moccasins torn and worn out, you know. And it was cold — in October. But they were on their way.”

Some stayed and their descendants remain in Canada. Wapato’s grandfather returned to the U.S. and was arrested and sent to Oklahoma.

The Forest Service is holding a series of public meetings in Oregon, Idaho and Washington through early October. They’re asking for public comment on adding an extra section and making other updates to the trail.

Scientists Discuss Long-Awaited Scientific Volume On ‘Kennewick Man’ Skeleton

A skeleton that’s about 9,000 years old is giving up a few of his secrets today. Monday, scientists who have a new book about the ancient remains found near Kennewick 18 years ago spoke to the press.

The volume titled, “Kennewick Man: The Scientific Investigation of an Ancient American Skeleton,” is due to hit bookstands in mid-September.

Kennewick Man was found resting in the shallow water of the Columbia River 18 years ago. His early story was that of some strife. A rock-point is buried in the bone of his hip.

The Northwest tribes that want to rebury the ancient remains, and the scientists that want to study him fought for years in court. This new book reveals the studies that were ultimately allowed by federal court.

The book explains that Kennewick Man was likely a coastal sea hunter from the far north. And he hadn’t been in Washington’s desert too long.

“He lived most of his life in coastal locations, north of the state of Washington,” said Doug Owsley, the book’s co-editor. “And in keeping with these findings you know if you look at Kennewick Man’s dental wear its reminiscent of working hides, and similar to really wear that we see in early Eskimo skeletons.”

Owsley says there’s still one question he’s dying to answer: What kind of rock is the stone point made from that’s buried in K-man’s hip? That would give clues to his routes across the North American landscape.

Northwest Tribes Exult as Nearly One Million Chinook Return to Columbia River

Northwest tribes are exultant to see nearly a million fall Chinook salmon returning to the Columbia River this year, nearly 400,000 more than have returned since the Bonneville Dam was built 75 years ago.

With a month still left in the run, said the Columbia River Inter-Tribal Fish Commission in a media release, more than 920,000 adult and jack fall Chinook had already come up the river. Among the record numbers cited: On September 9 alone, 63,780 fall Chinook were counted crossing the dam, the Fish Commission said. Chinook also returned to tributaries in the 140 miles of river downstream, adding to the huge run, the commission said.

The abundant, historic run is due to several factors, the commission said, some of which began between two and five years ago. River flows were high in spring, when the juvenile fish migrated to the ocean back then. In addition juvenile fish have spilled over dams, ocean conditions have been good, and numerous ongoing projects have been undertaken to improve the fishes’ ability to pass by dams and exist in their spawning habitat. Higher survival of hatchery-produced fish also contributes to the historic numbers, said the commission.

“The abundance of this year’s fall Chinook run is the perfect example of what this region needs to focus on and how we all benefit from strong returns,” said Paul Lumley, executive director of the Columbia River Inter-Tribal Fish Commission, in the statement. “Partnerships and collaboration are rebuilding this run. Focusing on rebuilding abundance allows the region to move beyond unproductive allocation fights and puts fish back on to the spawning grounds.”

In addition, an abundance of jacks, three-year-olds and four-year-olds are harbingers of a potentially big return next year as well, Pacific States Marine Fisheries Commission biologist Joe Hymer told The Columbian.

Salmon experts, including those at the commission, cautioned that the work was not over.

“You can’t lose sight of the fact that there are 13 distinct populations of salmon that remain at risk,” said Joseph Bogaard, executive director of the conservation group Save Our Wild Salmon, to the Los Angeles Times. Those species in the Columbia and Snake rivers are listed as either threatened or endangered under the federal Endangered Species Act, he said.

Indeed, recent studies have shown that overall in the region, salmon habitat is deteriorating faster than it can be restored.

And even as Chinook shattered records, the Technical Advisory Committee, made up of managers of state, tribal and federal fisheries, noted that returns of summer steelhead, fall Chinook and coho were down, The Seattle Times reported.

“Is this something to celebrate? Absolutely,” said commission spokeswoman Sara Thompson to the Los Angeles Times. “But this is one population of salmon. There is still more work to do.”
